诺齐克的自我所有原则及柯亨的批驳

【摘 要】Nozick is a libertarian representative who advocates the individual

rights and freedom. The principle of self-ownership is his political and

philosophical foundation. The combination of self-ownership and the

unequal distribution of the original resources will make the private right of

all kinds of substances unequal, resulting in unequal opportunities. He

thought the inequality can't be solved. Freedom and equality are not

compatible. But based on the doubt and analysis of the principle of self-ownership, Cohen demonstrated that the principle of self-ownership

doesn't inevitably lead to inequality. Under the external resource sharing

system, freedom and equality are compatible. Thus shaking the foundation

of Nozick's theory of rights, which is the ul- timate criticism to his theory

of justice.%诺齐克是自由至上主义的代表，主张个人权利和自由。自我所有原则是其政治哲学的基础，他认为不平等是不可解决的，自由与平等不相容。但柯亨通过对自我所有原则的质疑和剖析，论证了自我所有原则并不必然导致不平等，在外部资源共有体制下，自由和平等是相容的，从而撼动了诺齐克权利理论的根本，是对诺齐克持有正义理论的终极批判。
